Service availability

By placing an order on the Website, you warrant that you are over 18 years of age. The products offered are distributed on national territory.

You may purchase from the country of your choice, but we will only be able to ship your order to addresses located in the country of your choice. When you change country, shipping methods, delivery points and other sales conditions will be updated.

Pursuant to Art. 40 of Law 47/2002 reforming Law 7/1996 of January 15, 1996 on Retail Trade and Law 34/2002 of July 11, 2002 on information society services and electronic commerce, before placing the order, the Buyer has the right to be informed on the Site of the essential characteristics of the products he wishes to order.

Purchase procedure

    1. The items to be purchased must be selected and added to the shopping cart by clicking on the corresponding icon.

 

    1. The shopping cart will contain the reference of the selected item, its name, quantity and price in euros (taxes included). The price quoted does not include shipping, whose rates will vary depending on the shipping method selected.

    1. The Contract shall relate only to the product(s) credited in the Confirmation. TRIWUU shall not be obliged to supply any product(s) which have not been confirmed.

 

    1. The receipt of the order confirmation does not mean the acceptance of the order by TRIWUU at the purchase price. Depending on the number of users who sign up for the offer, the price may vary. The order will be confirmed by mail at the end of the validity of the offer for the best price obtained, never worse than the one that was made, the amount of the order will be retained but not charged to the customer’s account.

 

  1. At the end of the period of validity of the offer, the amount for which the offer has been closed will be charged, which will always be equal or cheaper than the amount for which the order was placed. You agree to be charged an amount equal to or less than the amount you accepted at the time of purchase.

Product availability

TRIWUU has availability of all products offered on its website. In the event that due to an inventory error there was no availability, the customer would be notified immediately.

Right not to accept an order

REMUNERATION TO USERS

Remuneration conditions

Triwuu will remunerate those users who share the link with their contacts after purchasing the product, if these contacts end up purchasing the product through the link.

Terms and conditions will be reflected in each offer at the time of sharing and may vary depending on the offer.

Coin purse and balance availability

Users will have a piggy bank where all their payments will be deposited and can be redeemed for purchases on our website.

The balance generated will be available 15 days after delivery of the product to the contacts, when the purchase is fully effective.

Methods of payment

TRIWUU will only accept payments made by credit or debit card and the balance in your wallet.

TRIWUU accepts payment for purchases made through the Website with the following credit or debit cards: Visa, Mastercard and American Express.

In case the payment method chosen by the customer is a credit or debit card, the charge will be made online, that is, in real time, through the payment gateway of the corresponding financial institution, once it has been verified that the data provided are correct.

In case the payment method is through the wallet, the customer will be able to deduct the balance from the purchase amount, by checking the corresponding check, with the limit established in each offer.

Payment security

In order to provide maximum security to the payment system, TRIWUU uses secure payment systems of leading financial institutions in electronic commerce. In this sense, the confidential payment data are transmitted directly and encrypted (SSL) to the corresponding financial institution.

For payment with Visa, MasterCard and American Express cards, TRIWUU only accepts CES (Secure Electronic Commerce) transactions including, if applicable, the international 3D Secure protocol which is distinguished by the Verified by Visa, MasterCard SecureCode and American Express Safekey marks. Secure Electronic Commerce is an initiative whose basic principle is to guarantee the security of Internet transactions.

When making the payment through the secure payment gateway, the system will automatically verify that the credit card is activated for Secure Electronic Commerce. It will then connect to the issuing bank, which will ask you to authorize the transaction by means of a personal authentication code. The transaction will only take place if the bank issuing the credit card confirms the authentication code. Otherwise, the transaction will be rejected.

As a complementary measure to the “Secure Payment” system and with the aim of collaborating in the prevention of fraud over the Internet, TRIWUU reserves the right to verify the personal data provided by the customer and to take the measures it deems appropriate (including the cancellation of the order) so that the goods purchased are delivered in accordance with the data contained in the order.

Purchase limit

The purchase limits will be those established by Triwuu for each purchase, with the restriction of the quantity field.

DELIVERY

The risk of the products shall be borne by the customer from the time of delivery. The shipment of the products purchased through the Web Page will be made through a courier company and will be delivered within the period indicated in each offer within each file.

The shipping cost will be reflected in the shopping cart of each product and will vary according to the real and volumetric weight of the product.

To avoid delivery incidents (wrong addresses, inability to find someone at home, etc.), it is essential to fill in the corresponding form correctly.

The tracking of orders can be done through the link included in the orders section of your personal account by accessing the corresponding order. Here you will be able to see the status of your order and transport.

The exact price of shipping will be calculated when each item is placed in the shopping cart and will be displayed on the page summarizing the purchase before the customer confirms the order by clicking on the “Confirm payment” button and before entering the payment details.

It will not be possible to ship orders to PO Boxes. Shipping costs may be changed at any time without prior notice. Such change will be applicable from the moment the modification is included in these Terms and Conditions of Sale. In any case, the shipping costs that appear at the time of placing the order will be valid.

ONLINE RETURN AND/OR EXCHANGE POLICY. RESPONSIBILITY

Right to withdraw from the purchase

You have the right to withdraw from this contract within fourteen calendar days without giving any reason.

The withdrawal period shall expire fourteen calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired the material possession of the goods. You shall bear the cost of shipping for the return of the goods.

To exercise your right of withdrawal, you must notify Triwuu at our address at Iparraguirre 65 1º izda.48010 Bilbao or by email to info@triwuu.com your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post or email).

In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiration of the withdrawal period.

Consequences of withdrawal:

In the event of withdrawal by you, we will refund the payment received by you for the goods, not for the shipping costs incurred by you in returning the goods without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to effect such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you will not incur any costs as a result of the reimbursement.

Return conditions

For health reasons, food products that could deteriorate or expire quickly will not be accepted for return.

For hygienic reasons, sealed products, such as underwear without the label or protective device, cannot be returned. Personalized garments and accessories cannot be returned.

To exchange a product for a different one, the customer must return it and make a new purchase.

All returns of purchased products must be carefully packed in the original packaging.

Return of faulty or defective products

In the event that TRIWUU has sent by mistake a product different from the one ordered, that the quality of the product sent is not adequate or that the product does not conform to the contract, TRIWUU, after verifying the error or defect, will fully refund the amount of the returned product and the shipping costs incurred in the delivery. The customer must use the means of transport of Triwuu for the return of the order.

The reimbursement must be made without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to effect such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you will not incur any costs as a result of the reimbursement.

You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

WARRANTIES

To customers who make purchases as consumers, TRIWUU offers guarantees on the products sold through the Website, in accordance with Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter “TRLGDCU”).

For any lack of conformity at the time of delivery of the good, TRIWUU will respond to the consumer for the faults that are manifested during a period of three years from delivery, which shall be deemed made on the day that appears on the invoice or receipt of purchase, or on the delivery note if this is later;.

In the absence of proof to the contrary, it shall be presumed that any lack of conformity that becomes apparent within two years of delivery of the good was already present when the good was delivered.

By means of a simple declaration, the consumer may require TRIWUU to remedy the lack of conformity, reduce the price or terminate the contract.

For the good to be brought into conformity, the consumer may opt for repair or replacement, unless one of these two options is impossible or involves disproportionate costs for the trade. These measures must meet the following requirements:

  • They shall be free of charge for the consumer, including the costs necessary for the goods to be brought into conformity, in particular the costs of shipping, transport, labor or materials;
  • They will be carried out within a reasonable time from the moment TRIWUU has been informed of the non-conformity and without major inconvenience for TRIWUU.

The consumer will place the good at the disposal of TRIWUU, who will recover it at its expense in the way that generates the least inconvenience to the consumer depending on the type of good.

It shall not be liable for any payment for the normal use of the replaced goods during the period prior to their replacement.

TRIWUU, for its part, will recover the good at its expense, remove the non-conforming goods and in the case of goods that have been installed, it will remove them and proceed to install the repaired or replaced good, assuming the costs arising therefrom.

It shall provide the consumer with documentary evidence of the delivery of the good by the consumer stating the date of delivery and the lack of conformity, as well as documentary evidence of the delivery of the good already in conformity to the consumer, which must also state the date of such delivery and a description of the corrective measure carried out.

The consumer may also demand a price reduction or termination of the contract.

The reduction of the price shall be proportional to the difference between the value that the good would have had at the time of delivery if it had been in conformity, and the value that the delivered good has at the time of such delivery. The resolution will not proceed when the lack of conformity is of minor importance. The consumer may opt for the same provided that the following requirements are met:

  • When the measure to bring the goods into conformity proves impossible or disproportionate;
  • TRIWUU has not carried out the repair or replacement or has not carried it out correctly;
  • Any nonconformity appears on the repaired or replaced good; – The nonconformity is of such gravity as to justify one of the two options;
  • TRIWUU has declared or it appears from the circumstances that it will not bring the goods into conformity within a reasonable time or without major inconvenience to the consumer.

TRIWUU will reimburse the consumer as a consequence of the choice of this measure the price paid for the goods upon receipt of the goods or, where appropriate, of a proof provided by the consumer that he has returned the goods.

The consumer or user shall return the goods to the merchant, at the latter’s expense.

  • The consumer may suspend the outstanding payment of the price until TRIWUU fulfills its obligations;
  • It may also request the remedy of the lack of conformity, the reduction of the price or the termination of the contract, if, as a consequence of the infringement of third party rights, the use of the good is prevented or limited;
  • The consumer shall not be liable for any payment for the normal use of the replaced goods during the period prior to their replacement;
  • Whether you request the correction of the lack of conformity, the reduction of the price or the termination of the contract, you may claim damages if appropriate.
ASSIGNMENT AND WAIVER OF RIGHTS

The customer may not transmit, assign or transfer a contract or any of the rights or obligations arising therefrom without having obtained TRIWUU’s prior written consent.

No waiver by TRIWUU of any particular right of action arising hereunder shall constitute a waiver of any other rights or remedies unless expressly communicated in writing.

In accordance with the legislation governing the ownership of intellectual and similar rights, this Site and all its elements, trademarks, designs, photographs, texts, illustrations, logos, animated or not, sound or not, graphics, etc., as well as their compilation, are the exclusive property of the Seller, who grants no license or right other than the right to consult the Site.

The use, reproduction, duplication, copying, sale, resale, resale, accessibility, modification or any other exploitation, in whole or in part, of the Site, its content or trademarks for any purpose is prohibited, except with the prior written permission of the Seller.
